QUALIFICATIONS
Income: Must have an income that exceeds their monthly expenses. This is to ensure that the applicant has the financial ability to afford to be in the Chapter 13 Plan.
Debts: Your secured debts cannot exceed $1,257,850. Your unsecured debts cannot exceed $419,275. (Because of inflation, these amounts may be adjusted from time to time with the last adjustment done on April 1, 2019)
Taxes: Must be current on your Income Tax filing
Means Test: Must be able to pass the Means Test for income requirement. You can analyze median income tables here. Under a subtitle "Data Required for Completing Form 22A and Form 22C" find the appropriate time period in the drop-down menu (usually the most recent one) and click in the link that says "Median Family income based on State and Family size" and look for the information there.
Debt Counseling: As with Chapter 7 bankruptcy, you must meet the Debt Counseling Certification as required under the bankruptcy code.
