QUALIFICATIONS
Residency: Must have resided in the bankruptcy jurisdiction in which one files for a minimum of 180 days or in the state for at least two years.
Means Test: Must be able to pass the “Means Test” for income requirements. This essentially requires that your ability to pay back your debts be limited and fall below set standards of assets and monthly income. You can analyze median income tables here. Under a subtitle "Data Required for Completing Form 22A and Form 22C" find the appropriate time period in the drop-down menu (usually the most recent one) and click in the link that says "Median Family income based on State and Family size" and look for the information there.
Debt Counseling: Must meet the Debt Counseling Certification as required under the section 109 (h) of the bankruptcy code.
Prior Filing: If you previously filed for bankruptcy, then you must have received a Chapter 7 discharge within the last 8 years or filed a Chapter 13 case within the last 6 years from the date of filing. You may not be able to file a Chapter 7 if a previous Chapter 7 or Chapter 13 case was dismissed within the past 180 days.
